Purpose and acceptance

Access to and use of this Site grants the status of user and implies full acceptance of the terms set out in this Legal Notice. The Owner may modify the content of this document, as well as the configuration and presentation of the Site, at any time and without prior notice; it is the user's responsibility to check it periodically.

Nature of the services and limitation of liability

CanariasHOST^® is a technology services company dedicated to hosting and managing web platforms, administering cloud infrastructure, integrating artificial intelligence into digital projects, and providing technical and editorial support for various sites and blogs. The service, feature and project descriptions published on the Site are for informational purposes only and do not constitute a binding commercial offer, nor do they replace the specific proposal, quote or contract agreed, where applicable, with each client.

The Owner does not guarantee, and expressly excludes all liability, to the maximum extent permitted by applicable law, in relation to:

The availability, continuity or uninterrupted operation of the Site or of the platforms it manages, as well as damages resulting from technical failures, interruptions, cyberattacks, viruses or other elements beyond the Owner's reasonable control.
The content, operation or availability of third-party sites, applications or platforms that the Owner may manage, host or mention on behalf of its clients, responsibility for which lies with their respective owners.
The specific results of projects, integrations or developments, unless expressly agreed in the corresponding contract or quote.

Any decision to engage the Owner's services made on the basis of the information published on the Site is the user's sole responsibility; the actual scope of the service should be confirmed through the corresponding contract or quote.

Third-party links

The Site may include links to third-party websites. The Owner assumes no responsibility for the content, privacy policy or practices of such sites, whose access and operation are beyond its control.

Intellectual and industrial property

«CanariasHOST^®» is the distinctive name under which the Owner provides its services and operates the Site. The use, reproduction, imitation or registration of this name, or of any sign liable to be confused with it, by unauthorised third parties to identify services identical or similar to those of the Owner is prohibited; the Owner reserves the right to bring the civil and criminal actions recognised by trademark, industrial property and unfair competition legislation.

Likewise, the texts, design, code, logos, images and other content of the Site are protected by intellectual property rights belonging to the Owner or to third parties who have assigned them to the Owner. Their reproduction, distribution, public communication or transformation, in whole or in part, is prohibited without express authorisation, except for quotation with attribution of the source and a link to the Site.

Privacy policy

The Owner, as data controller, processes any personal data the user may provide (for example, through contact or subscription forms) in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD).

Purpose: to manage enquiries or requests submitted by the user and, where applicable, to send informational communications if the user has expressly requested them.
Legal basis: the data subject's consent, given when using the forms provided on the Site.
Retention: for as long as a mutual interest exists, or until the user requests their deletion.
Recipients: data is not shared with third parties except where legally required.
Rights: the user may exercise their rights of access, rectification, erasure, objection, restriction and portability by contacting info@canarias.host, and may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if they consider their rights have not been properly addressed.

Newsletter: if the user subscribes to a newsletter of any of the platforms managed by the Owner, their email address is used exclusively to send that newsletter and is not shared with third parties. Delivery is carried out through Postmark, an email delivery provider that acts as data processor and which, in accordance with its own retention policy, keeps the content of the email for a maximum of 45 days. The user may unsubscribe at any time via the link included in each message.

The Owner does not guarantee the absolute security of data transmission over the internet, although it adopts reasonable technical and organisational measures in line with the state of the art.

Cookie policy

This Site uses exclusively technical and necessary cookies for its correct operation (for example, the session cookie and the cross-site request forgery protection cookie), essential for browsing, security and use of the Site itself.

To understand how the Site is used, the Owner uses Umami, a web analytics tool installed and hosted on its own servers, with no third party involved. Umami does not use cookies and stores no information on the user's device; it creates no persistent identifiers, does not track browsing across different websites and does not build profiles. Only aggregate data is recorded: the page visited and its title, the language of the version consulted, the referring page or search engine, the country and approximate region or city, and the type of device, operating system, browser and screen resolution. The IP address is not stored: it is used only at the time of the visit to derive that approximate location and, together with other technical data, to generate a session identifier that is renewed daily and that does not allow a person to be identified or recognised on subsequent visits.

In accordance with Article 22.2 of the LSSI-CE and the criteria of the Spanish Data Protection Agency, both strictly necessary or operational cookies and audience measurement that stores no information on the user's device are exempt from the requirement to obtain prior consent, so this Site does not display or require a cookie notice, banner or authorisation.

The Site does not use advertising, personalisation or third-party tracking cookies, and does not share browsing data with third parties. Should any such service be incorporated in the future, this policy will be updated and the consent legally required, if any, will be requested.

The user may, at any time, configure or block these cookies through their own browser settings, although this may affect the correct operation of the Site.

Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For any dispute arising from access to or use of the Site, the parties submit, expressly waiving any other jurisdiction that may apply to them, to the Courts and Tribunals with jurisdiction under the legislation in force on consumers and users, where applicable.
